“Is it better to perform Jumuah Salaat in a Musjid or at the Ijtima?

ANSWER

There should be no difficulty in understanding that the Tabligh Jamaat Ijtima’ can never have preference and significance over and above a Musjid.

Those who are able to perform Jumuah in a Musjid, should not abandon doing so for the sake of joining the merrymaking crowd at the ijtima which has absolutely no significance in relationship to the Musjid.

It is with sadness we observe that Ulama such as Moulana Khatani who with passion promote and propagate through the efforts of Tabligh as a reminder to Muslims to bring the commands of Allah and the Sunnah of Nabi Sallallahu Alaihi Wasallam in our lives, to attain forever lasting success.

Moulana Khatani with passion renders heart rendering bayaans to bring Imaan & Yaqeen into one’s life with no compromises for our Aakhira. To bring our lives into total obedience of Allah and the way of Nabi Sallallahu Alaihi Wasallam as one’s prime objective in life.

Now today we find ourselves in a dilemma, particularly our leaders, be it in Tabligh, the Khanqas, our Imaams in our masaajid, in learning and teaching, in social welfare services, etc. we have a group of Ulama and organisations who are in direct contradiction of the commands of Allah and the Sunnah of Nabi Sallallahu Alaihi Wasallam. For example, Ulama who supposed to lead and set a practical example to demonstrate us as followers the obedience of Allah and the Sunnah of Nabi Sallallahu Alaihi Wasallam

  1. Openly closing the masjids and introducing new ways of Salaah, i.e social distancing, etc. Moulana Khatani in these times encouraged us to flock to the masjid and obey the orders of Allah, Alhamdulillah
  2. Ulama who went as friends of the court to oppose keeping the masjids aabad and open, Read Surah Baqrah Ayaat 114
  3. Openly giving up Salaah in the masjid to have Salaah in the soccer stadiums, who openly stated “What’s the big deal?” “For ONE Jummah!”
  4. Who promote and openly cry to send our precious girls to universities to become doctors. So to say put our girls in the lions mouth in the environment of LGBT, sex and rave culture and all that goes with it.
  5. Who openly intermingle and take videos & photos with women.
  6. Who compromised the very same Mimbar, where Moulana Khatani delivered his

Eid Bayaan, to a corrupt president

  1. Who had no issues when Abu Hurayra Radiallahu Anhu was mocked at, at the marriage conference in the presence of these very same Ulama.
  2. Who openly promote inter-faith ideologies and attend inter-faith prayers and funerals and are then called Reverend by the politicians
  3. Who openly host political campaigns and are proud to be at SONA as the first Muslim accredited interviewers, freely interviewing half naked female MP’s and inter-mingling with them. Is this what they become Ulama for?
  4. Openly coming on TV, the same Ulama who in the past, told us, “Don’t watch the devil box.” It seems the devils are now on the box.

Moulana Khatani the Ummah on Haq’s question to you? Is the command of Allah and the Sunnah of Nabi Sallallahu Alaihi Wasallam that we need to bring in our lives to attain forever lasting success, Is this the way of our pious predecessors, like Moulana Ilyaas Rahmatullah Alaih? Is this what Moulana sobbed for day and night?

With your presence at the Eid Gah as a guest speaker, what message of Dawaat & Tabligh are you giving to the Ummah at large? Yes, Moulana Khatani as a representative of Nabi Sallallahu Alaihi Wasallam and Moulana Ilyaas Rahmatullah Alaih, what you are saying, that “I Moulana Khatani is ok with all this and the commands of Allah and the Sunnah of Nabi Sallallahu Alaihi Wasallam is now secondary, never mind my talks in the past.”

Moulana Khatani by you attending this Eid Gah as a guest speaker you are clearly making a profound statement, you are happy with the open public sins of these Ulama who have no link with Haq and you fully endorse what they doing. Instead of this being the platform for Dawaat & Tablig under these ‘weird’ circumstances you are better off going house-to-house to propagate the message, there will be greater Barakaat in this. And go to these very same Ulama, to their houses and remind them of the wrongs and its everlasting harm to Deen and the Ummah at large.

Moulana Khatani by you declining this invitation as a guest speaker, you would have sent a very clear message, stating that, “Supreme are the commands of Allah and the Sunnah of Nabi Sallallahu Alaihi Wasallam, Deen has no place for deviation and innovations, no matter who you may be, you could be my brother or my bosom friend. You chose the opposite.

Our simple observation is that for years what our leaders have been telling us, are now being tested, no more impressive talking, what is required, is bold decisions and actions to give a clear message of HAQ.

“The DEEN of ALLAH and HIS NABI NABI SALLALLAHU ALAIHI WASALLAM is not for sale for a few coppers.” This is a sacrifice of the day. We will be tested by our own, that’s the challenge in these times.

Moulana we feel ashamed today we am reminding you to turn to ALLAH and make the right choice, the choice for ALLAH’s DEEN not for Insaan and the forces of baatil and name and fame. Your decision has set the record straight to those who are openly presenting a deviated Deen and those who are on Haq.

May Allah Guide us all on the TRUE DEEN, the one where every week an Elhan is made for “My Success and your Success is to obey the commands of Allah and the Sunnah of Nabi Sallallahu Alaihi Wasallam in our lives to attain forever lasting success”

THE FITNAH OF WOMEN

Q. A women‟s organization is propagating with Hadith the permissibility of women attending the Musjid. Is there any validity in their arguments based on Hadith.
A. We have published six books on the prohibition of women attending the Musjid. This fitnah is set to increase just as all other fitan as we approach Qiyaamah. The problem is that the molvis themselves are allowing this women‟s fitnah to gain momentum.
They lure the women into the public domain to listen to their lectures. The women therefore become more audacious regarding Salaat. If they can come to the Musjid to listen to talks, then why can‟t they come for Salaat. This is their baseless argument based on the haraam actions of the molvis.
Our booklets answer all the stupid and baseless arguments of the legalizers of this prohibition. The Tabligh Jamaat too is guilty of having made women audacious. If they can roam around for so-called tabligh, why can‟t they attend the Musjid for Salaat? This is another shaitaani baseless argument which stems from the haraam act of the Tabligh Jamaat. The crank „sufi‟ sheikhs are also guilty of having ruined the morals of women. They invite women to thikr sessions and for their bayaans. Thus, the women argue that to a greater degree should it be permissible for them to attend the Musjid. In brief, those who are supposed to be the people of the Deen are subverting the Deen. They have opened many avenues of haraam with their shaitaani „hikmat‟.

DAWAT OR IBAADAT

Q. The Tabligh Jamaat says that first comes da‟wat, then Ibaadat. Is this correct?
A. For a Muslim the first act is Ibaadat. Fardh, Waajib and Sunnatul Muakkadah cannot be delayed for da‟wat.
Da‟wat is an act which blends into one‟s daily life, starting at home with naseehat to the wife and children. It is to be executed whenever one finds it opportune. Da‟wat is not confined to tabligh jamaat activity. Allah Ta‟ala has created us for His Ibaadat. All other Deeni activities are subservient and secondary to Ibaadat. The Tabligh Jamaat talks drivel and is lost in gulu‟ (haraam bigotry).

NASEEHAT FOR THE TABLIGH JAMAAT

From Mauritius a Molvi Sahib querying the status of the Tabligh Jamaat, writes:
Q. What is the status of the Tabligh Jamaat. Among its beliefs, practices and attitudes are the following:

(1) They regard their specific methodology of tableegh to be Fardh-e-Ain. In both belief and practice they display this attitude.

(2) They narrate maudhoo’ (fabricated) and extremely dha-eef (weak) narrations, and justify these on the basis of far-fetched interpretation.

(3) They resort to tahreef-e-ma’nwi of the Qur’aan and Ahaadith, e.g. they apply the Aayaat and Ahaadith of Jihad to their specific method of tableegh. The fadhaa-il which are related specifically to Jihad are applied to their tareeqah of tableegh.

(4) They regard only their method to be valid tableegh while they despise all other forms of Tableegh such as Madaaris, Khaanqas, etc.

(5) They are opposed to Qur’aan dars. They believe that teaching the Qur’aan leads to disunity.

(6) A mubah practice leads to fasaad on account of the excesses.

(7) Unqualified persons are appointed zimmidaars.

What is the Shariahs view regarding the Tabligh Jamaat movement on the basis of these factors? Is it therefore not proper to declare the Tabligh jamaat a deviant sect?
ANSWER

Undoubtedly, there is much ghulu’ (haraam extremism) in the Tabligh Jamaat. All the facts you have enumerated, besides No.5, are correct. The Tabligh Jamaat is undoubtedly veering away from Siraatul Mustaqeem.

With regard to No.5, above, the Jamaat is not anti-Qur’aan. Anyone who is opposed to the Qur’aan becomes a kaafir. The reason for not allowing Qur’aan dars, is to avoid baatil being imparted. Qur’aan dars is not to be imparted by laymen. Most of the speakers and ‘zimmidaars’ of the Jamaat are from the masses or lack adequate expertise. Baatil interpretations from baatil commentaries will be propagated under the auspices of the Tabligh Jamaat if Qur’aan dars is allowed. The Tabligh Jamaat has six principles. It is necessary that they remain within the confines of their SIX points in order to ensure that the Jamaat stays on the course of the Shariah. Divergence from the six points will lead to greater corruption and propagation of baatil.

The Tabligh Jamaat is a mass movement, hence infiltration by baatil and corrupt elements cannot be avoided. People from baatil sects can easily infiltrate and misguide their audiences with baatil commentaries. Therefore not allowing Qur’aan dars is valid.

Although it is conceded that the Tabligh Jamaat has strayed from Siraatul Mustaqeem, at this juncture it is not appropriate to label the Jamaat a deviant sect. However, if the Jamaat continues along its current trajectory of ghulu’, then the time will come when there will be no option but to excommunicate the Tabligh Jamaat for having become one of the baatil sects. It is our fervent dua that the elders of the Jamaat divest themselves of the bigotry and ghulu’ which have fossilized their thinking. Thus, they are unable to discern the grievous errors which have already corroded the Jamaat and split the Jamaat into two hostile factions each one harbouring intense shaitaani hatred for the adversary.

It is undeniable that innumerable Muslims all over the world have derived considerable Deeni benefit from the activities of the Jamaat. In the curriculam of the Jamaat there is nothing in conflict with the Shariah. It is the shaitaani attitude of ghulu’ which has developed in the Jamaat which threatens the existence of the Tabligh jamaat as a movement of Haqq.

The Tablighi groups all over the world are still engaging in teaching only what the Shariah allows. Their ta’leem is restricted to the Kalimah, Tahaarat and Salaat. They are not propagating beliefs of baatil. It is only their evil attitude of ghulu’ stemming from ujub and kibr which has sullied the Jamaat. Their success which they lamentably base on numbers, has intoxicated them with pride and vanity, hence the ghulu’. They measure success on the basis of the number of people attending Ijtimas, on the number of busloads of people, and the number of jamaats sent out.

They have not understood the true Maqsad of the movement. They are fossilized into the idea that the Tabligh Jamaat is the Maqsad (the actual objective of tabligh). They have also failed to understand the meaning of Tabligh, hence they believe that only their specific methodology is tabligh, and all other Deeni activities are futile. This attitude is indeed lamentable and dangerous.

Despite the many ghulu’ deviances, it is not proper at this juncture to brand the Tabligh Jamaat a sect of baatil. The Jamaat is like a damaged ship, listing on its side and adrift on the ocean. It can still be saved from sinking and perishing. It is incumbent for those Ulama who understand the ghulu’ of the Jamaat, to resort to Amr Bil ma’roof. Intelligent people who are not Ulama should also draw the attention of the Jamaat people to their grave errors. Silence and condonation of the evil ghulu’ are aiding the process of the destruction of the Jamaat.

The ghulu’ compound of the Jamaat consists of a number of evil ingredients:

(1) The notion that Tabligh is confined within the specific methodology of the Tabligh Jamaat.

(2) Deriding all other forms of Tabligh.

(3) Believing that the Tabligh Jamaat is like the Ship of Hadhrat Nooh (Alayhis salaam). The implication of this corrupt understanding is that whoever is not in the Tabligh Jamaat is a kaafir doomed for perdition.

(4) That the specific method of the Tabligh Jamaat is Fardh-e-Ain.

(5) Misinterpretation of the Qur’aanic Aayaat and Ahaadith to convey the idea that the Fadhaa-il for Jihaad substantiated by Nusoos apply to the specific Tabligh Jamaat methodology. This is tahreef (haraam interpolation and misinterpretation).

(6) Insisting stupidly on joining the Jamaat for extended periods although adequate arrangements for the family at home are not made. Many Tablighi chaps abandon their families, leaving them without sufficient house expenses and without mahrams.

(7) Condoning, in fact, even encouraging women who join the Tabligh Jamaat to travel without mahrams if not available.

(8) The Makshufaat groups which are erroneously dubbed ‘masturaat jamaat’.

9) Wasting huge sums of money on ijtimas when there is no real and no imperative need. These ijtimas are gradually assuming bid’ah proportions.

10) Amenability to Bid’ah. Since the focus has shifted from the Maqsad of Tabligh, Bid’ah has crept into the Jamaat. Among their Bid’ah acts is the haraam act of expunging the Shariah’s rule pertaining to Sunnatul Muakkadah Salaat. Ittisaal (i.e. joining or performing without undue delay) between the Fardh and Sunnatul Muakkadah is Waajib. After the Fardh of Zuhr, Maghrib and Isha’, there are two raka’ts Sunnatul Muakkadah. Instead of engaging in the Sunnatul Muakkadah immediately after the Fardh, the Tablighis have introduced the practice of kitaab-reading. This act is in flagrant disregard for the Shariah. They accord preference to their own methodology over the Shariah. Thus this practice is Bid’ah.

Another Bid’ah, is to interfere with the concentration of the Musallis. Even before the Musallis have completed their Sunnat Salaat, the Tablighis rush to the front, face the Musallis who are still engaged in Salaat, and disturb them with their announcement to join in the bayaan. This is indeed shameless and demonstrating disregard for the communion the Musallis have with Allah Ta’ala in Salaat. They lack the patience to wait until the Musallis have completed their Sunnat and Nafl Salaat. The haste they display in this impermissible performance is further evidence for the Jamaat having lost focus of the actual objective of Tabligh.

(11) Loss of Focus. A glaring example of loss of focus is the Jamaat’s wooing of villains such as Tariq Jameel whose religion brings within its scope acceptance of the baatil of Shiahs and of any and all hues of Fussaaq and Fujjaar. Merely because this Dajjaal is able to attract crowds, does the Jamaat deem it appropriate to include the villain within their ranks regardless of his blatant Shar’i infractions. Since the Maqsood is no longer the Pleasure of Allah Ta’ala, shaitaan has adorned baatil with deceptive ‘hikmat’ for acceptance by the Jamaat.

Once the public in Deoband had desperately kicked up considerable shaitaani smoke against Hadhrat Maulana Rashid Ahmad Gangohi (Rahmatullah alayh) who had rejected the proposal to appoint a prominent faasiq to be a member of the Shura Council of Darul Uloom. The severity of the fitnah had threatened the closure of the Madrasah. Senior Ulama advised Hadhrat Gangohi to accept the membership of the faasiq to save the Madrasah closing. Thousands of Students would be deprived of Ilm-e-Deen if Darul Uloom had to close.

Hadhrat Gangohi, Imaam-e-Rabbaani, resolutely stated: The Madrasah is not the Maqsood. Ridha Ulaahi (the Pleasure of Allah) is the Maqsood.”

If the Madrasah has to close in the wake of the fitnah of the juhala, let it close. They will be hauled into the Divine Court to answer for their shaitaaniyat. Hadhrat did not compromise with baatil. The fitnah was extinguished and the faasiq was not accepted. This should be the attitude of the Ahl-e-Haqq.

Besides the aforementioned list of baatil, there are other infractions of the Shariah as well. Nevertheless, at this juncture it would not be proper to proclaim the Tabligh Jamaat a deviant sect among the 73 Firaqah Baatilah. We can only make dua that such a stage shall not be reached.

The need is to strive to reform the Jamaat by deracinating the bid’ah, baatil and ghulu’ which permeate all levels of the Jamaat – seniors and juniors, and which gnaws the foundations of Tabligh Jamaat. The Jamaat elders should become cognizant with reality, ingrain Ikhlaas in themselves, meditate on their infractions and understand the real Maqsood. They should not commit the fatal blunder of viewing our Naseehat as destructive criticism. Hadhrat Yahya Bin Muaaz (Rahmatullah alayh) said:

“Your Brother is he who alerts you to your deficiencies and your Friend is he who warns you of your sins.”

May Allah Ta’ala guide us all and save us from the villainy of our nafs and the snares of Iblees.

THE TABLIGH JAMAAT OF AUSTRALIA

I live in Australia. The Tabligh Jamaat Effort changed the Lives of Most of the Muslims in Australia.
(Have you done a proper survey of ‘most of the Muslims’ in Australia? If yes, please forward the results of your survey. –The Majlis)
Thousand of muslims have changed their ways from the road to Jahannum to the Road towards the mercy of Allah. Hundreds of Mosques are the result of the efforts of Tabligh. Many Ulama from South Africa have come to Australia to serve as PAID ulema by members of Tabligh. The Tabilgh has increased Fiqr for all Humanity and we send Jamaats to all countries of the world and our Jamaats consist of members from 31 Countries. Very few if any, South Africans). (Our advice is that the jamaats should work only within the borders of Australia, and not waste money on globe-trotting unnecessarily. There is no need for Australians to do tabligh, Tabligh Jamaat style, in other countries. There are ample folk in all countries for this type of tabligh. – The Majlis
Our Amir is Egyptian who has spend his last 50 Years establishing Madrassas, Darul Ulooms and still sending Jamaats to the world and neighbouring Islands and reviving Islam. We assure you that the South African Jamaats coming to Australia are very embarrassing and a Poor example of the Beautiful Work of Tabligh. (We are in full agreement with you on this point. They are in fact hoodlums, puffed with pride and arrogance. They despise even great Ulama and Auliya who are not associated with their specific tabligh methodology which is NOT Sunnah. They have even exacerbated the hostility between the two Tablighi baatil factions.- The Majlis)

There are now 3 Groups in Jamaat: the deviant Saad Group, the Conflicting Laat Group, and the group in Australia who are just simply adhering to Dawah in all its Forms as was originally guided by Nizamudin but now operates only in guidance from Allah and Rasoolallah (saw). (What is the meaning of ‘saw’? You are a Tablighi and supposed to have greater respect and honour for Rasulullah –Sallallahu alayhi wasallam. Is it then too onerous to write: Sallallahu alayhi wasallam? Why content yourself with the drivel of ‘saw’? In terms of your diagnosis there should be four Tablighi groups. Yes, we are removing any Bidah practises of Tabligh, as new participants are from various countries and Background, including Sheikh Worship etc, and the worst of the Ulema-e-soo we find are from South Africa. (Alhamdulillah! You have diagnosed correctly. The molvis of South Africa and the molvis of the U.K. are most certainly the worst ulama -e-soo’ under the “canopy of the sky” as mentioned by Rasulullah (Sallallahu alayhi wasallam). They are making a stinking, wretched hogwash of the Deen with their shaitaaniyat and nafsaaniyat. Most of these ‘muftis’ are maajinmoron fellows who are unable to distinguish between right and left, light and darkness. – The Majlis)
May Allah save the Umma from Shirk inshallah and having to ask everyone involved in the Efforts of Tabilgh and Deen for Forgiveness as Not All of us involved in Tabligh are Bereft of Sunnah and love of Allah or in Need of Improvement and Guidance from Allah.

You are the first Tablighi in all the decades of our life who has conceded that there is Bid’ah in the Tabligh Jamaat. In fact, Bid’ah and Ghulu’ (haraam bigotry) are rife in the Jamaat. It is this evil which has split the Jamaat into two hostile factions, each one waging shaitaani ‘jihad’ against the other. Our criticism cannot be restricted to the South African scenario. The deviance of the Jamaat exists in other countries as well, not only in South Africa. It is at its height in Bangladesh, India, Pakistan and United Kingdom. In the U.S.A. as well as other countries too, the evil of the split initiated by Sa’d has been imported.
If the Australian Tabligh Jamaat is as you have described, then you are most fortunate for not having been dragged into the cauldron of the shaitaaniyyat in which the Jamaat is floundering. Continue the good work on the six principles of the original Founder of the Jamaat. Abstain totally from ghulu’. There are numerous excesses and haraam acts of the Tabligh Jamaat from which it is imperative to abstain. The work of the Jamaat will be beneficial only if it is retained within the confines of the Shariah. It is essential that Jamaatis understand that the Tabligh Jamaat is not the sole repository of Najaat (Salvation) as is being satanically propagated. The haraam extremism prevailing among the rank and file is actually the teaching emanating from the elders of the Jamaat. Stupid laymen acquit themselves as if they are great ‘ulama’. The degree of arrogance and pride in the Tabligh jamaat is appalling and lamentable.
Your comment regarding the South African ulama is 100% correct. However, this rotten condition applies to almost all the ulama of all countries in this era. In terms of the description provided by Rasulullah (Sallallahu alayhi wasallam), “they are the worst of people under the canopy of the sky”. They betray the Deen, the Ummah, Allah Ta’ala and His Rasool (Sallallahu alayhi wasallam) with their haraam, stupid fatwas of liberalism designed for bootlicking to fulfil the demands of hubb-e-jah (love of fame) and hubb-e-maal (love of wealth). Thus they distort and mutilate the Shariah to justify their convoluted ideas and to argue away the prohibitions of Allah Ta’ala. They ruin the Imaan and Akhlaaq of the masses. The Tabligh Jamaat has also been performing this evil function. The Jamaat has become notorious for its ghulu’. Beware of such bigotry. Remain rigidly clinging to your six principles. The Tabligh Jamaat of this era has added an unwritten principle to their six. The seventh principle is Ihaanatul Muslim, i.e. to disgrace Muslims. Formerly they directed this shaitaaniyyat to those Ulama, even to Hadhrat Maulana Ashraf Ali Thanvi (Rahmatullah alayh), who are not associated with their specific tabligh methodology. They slanderously accused great Ulama of being anti-Tabligh. That is because they themselves do not understand the meaning of Tabligh.
As long as you remain within the limits of the Shariah, you will, InshaAllah, be successful in your efforts and Allah Ta’ala will then reward you abundantly. Wassalaam

I have come across an article in Majlis Vol 25 No.02 where it is mentioned that Greeting a Faasiq is Haraam. But, in our country, some Ulama have ruled that for Tablighi purpose, Salaam may be given. If Salaam is given to bring a Faasiq close to Deen, then it will not be Makruh.

I had received a mail on 16th December 2015 from Darul Iftaa Mahmudiyya un which Mufti Ebrahim Desai also passed the verdict of permissibility (refer to the trailing mail).So What should we practice ?

The following is the fatwa of Darul Ifta Mahmudiyyah:

Initiate Salaam with a Faasiq?

Question:
1) Is it permissible to initiate salaam with a faasiq (like a clean shaven and/or izaar below ankles)?

2) Is it permissible to smile at them?

3) As fisq and fujoor is widespread, how should we uphold the Sunnah of Smiling in public?
Answer:
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykumwa-rahmatullāhiwa-barakātuh.
You enquire how should one deal with a fasiq especially in this era where fisq is common and whether one can make Salaam to a fasiq and smile at them. Your question is relevant to our times.
A fasiq is he who commits a major sin and invokes the wrath and anger of Allah on him . This is a serious issue. If we show complacency to a fasiq and don’t care of the sin he commits, it is an expression of disregard to Allah. Such an attitude also makes one deserving of the wrath and anger of Allah. It is for this reason that praising and honouring a fasiq is prohibited.
Rasulullah صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ has said in a hadith,
عَنْ أَنَسِ بْنِ مَالِكٍ، قَالَ: قَالَ رَسُولُ اللهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: ” إِنَّ اللهَ عَزَّ وَجَلَّ يَغْضَبُ إِذَا مُدِحَ الْفَاسِقُ فِي الْأَرْضِ

It is reported from Anas (Radiallahu Anhu) he says, that Rasulullah صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ said, verily Allah ‘Azza wajal is angered when a Fasiq is praised on earth.
It should also be noted that we have the responsibility to correct and reform people around us. Allah says,
كُنتُمْ خَيْرَ أُمَّةٍ أُخْرِجَتْ لِلنَّاسِ تَأْمُرُونَ بِالْمَعْرُوفِ وَتَنْهَوْنَ عَنِ الْمُنكَرِ وَتُؤْمِنُونَ بِاللَّهِ وَلَوْ آمَنَ أَهْلُ الْكِتَابِ لَكَانَ خَيْرًا لَّهُم مِّنْهُمُ الْمُؤْمِنُونَ وَأَكْثَرُهُمُ الْفَاسِقُونَ

You are the best nation produced [as an example] for mankind. You enjoin what is right and forbid what is wrong and believe in Allah. If only the People of the Scripture had believed, it would have been better for them. Among them are believers, but most of them are defiantly disobedient. (Surah Aali-Imran, V 110)
If we do not stop evil and wrong, evil and immorality will become widespread and eventually good people will also get caught up in the evil. However correcting and reforming people is a huge challenge. This can only be possible with the help of Allah.

Shariah does not permit us to simply know and stay away from wrong; it is also our responsibility to correct the wrong. The focus of Shariah is the end result, change and reformation. For that, one has to apply his mind carefully and analyse what is the best approach in achieving the change and reformation. This is referred to as Hikmah (wisdom). Allah says,
ادع إلى سبيل ربك بالحكمة والموعظة الحسنة وجادلهم بالتي هي أحسن إن ربك هو أعلم بمن ضل عن سبيله وهو أعلم بالمهتدين
Call unto the way of thy Lord with wisdom and fair exhortation, and reason with them in the better way. Lo! Thy Lord is Best Aware of him who strayeth from His way, and He is Best Aware of those who go aright. (Surah al-Nahl, verse 125)
Reverting to your query, on whether one should make salaam to a fasiq and smile at him; this depends on what attitude will be most effective on such a person. At times, adopting a harsh attitude may be effective in jolting the sinful person as is the case of a very close family relationship. At other times, it may be better to be loving and diplomatic to such a person as in the case of a distant relationship.
To illustrate the difference between the two, Zaid is the father of Amr. Amr is indulged in some inappropriate conduct. In this situation, if the father adopts a negative attitude to Amr and he knows Amr will be deeply affected with such attitude and jolt him to change, then such an attitude will be appropriate and regarded as Hikmah.
If Zaid and Zahid just know each other, they are not family or close relatives. Zahid is indulged in some inappropriate conduct. It is not appropriate for Zaid to adopt a negative attitude to Zahid and ignore him as that will suit Zahid fine. In this case, he would be left free to do as he wishes. It is more wise and suitable for Zaid to be in touch with Zahid to distract him from the sin and use the opportunity to advise him.
While we should not honour a fasiq and we should not be complacent to sin, we have a responsibility to change the situation around with wisdom.
If it will be more effective in not making salaam and smiling, adopt that attitude. If making salaam and smiling will be more effective, adopt that attitude with the intention for changing and reformation.
In brief, which attitude will be most effective depends on the persons insight an careful analysis of the situation. And Allah knows best,

OUR RESPONSE

While the Ulama in Bangladesh and Mufti Ebrahim Desai in South Africa have ruled that it is permissible to offer Salaam to a faasiq, Allah and His Rasool ruled otherwise. The Fuqaha of Islam have also submitted to this ruling. They did not adopt the line of reasoning of the ulama who seek to override the Shariah with their opinion which they term ‘hikmat’. This type of corrupt ‘hikmat’ is baatil.

In our article we had even presented the ruling of Hadhrat Masihullah (Rahmatullah alayh) who is well-known for his tenderness and caution.

It is not permissible to make a haraam act halaal for the sake of tabligh. Wine, interest, gambling, zina, etc. are haraam. For the sake of tabligh to bring people close to the Deen it is never permissible to legalize these prohibitions. But the problem with the ulama of this era is that they lack baseerat. Making Salaam to a faasiq is haraam just as are the other abovementioned sinful acts. These sinful acts may not be ruled to be halaal for tabligh purposes.

The obligation of the Muslim is to obey Allah Ta’ala, not to undermine the Law of Islam. It is not permissible to utilize personal logic to cancel the prohibitions of the Shariah regardless of how noble the end and purpose may be. When the two Persian delegates came to meet Rasulullah (Sallallahu alayhi wasallam), he turned his Mubaarak face away from them in disgust because they were clean-shaven. Despite them being kuffaar not bound by the laws of Islam, and despite it being the occasion for da’wat and tabligh, Rasulullah (Sallallahu alayhi wasallam) adopted a harsh attitude and displayed his disgust. But today’s molvis promote fisq and fujoor with their corrupt fatwas and baatil views.

Hidaayat is Allah’s prerogative. Only He guides people. We are not able to guide people with our tabligh. We are only required to deliver the Message of the Deen and leave the hidaayat issue to Allah Ta’ala. In the Qur’aan Majeed, Allah Ta’ala informs our Nabi (Sallallahu alayhi wasallam):

“Verily, you (O Muhammad!) cannot guide those whom you love. But Allah guides whomever He wills, and He knows best who are to be guided.”
People cannot be brought close to the Deen with haraam. Assuming that they can be brought close to the Deen with haraam activities, then too it is sinful for us to adopt such measures which are sinful and which invite the la’nat of Allah Ta’ala. If Allah Ta’ala has ordained Imaan and Taqwa for a person, that person will acquire it. There is no need to adopt haraam measures for this purpose just as it is not permissible to adopt haraam methods for the acquisition of our Rizq.

Our Rizq has been ordained and is fixed. Haraam ways may not be adopted to acquire this predetermined Rizq.

These molvis are in fact implying that to acquire one’s halaal Rizq, haraam measures may be adopted. But they fail to understand that the purpose regardless of its nobility is not the objective if it is to be procured in conflict with Allah’s Law and Pleasure.

Mufti Ebrahim’s fatwa is a zigzag opinion. It is a fence-sitting attitude. He tries to meander his way to placate opposites. He says: “If making salaam and smiling will be more effective, adopt that attitude with the intention for changing and reformation.”
This is absolutely baatil. By the same token it could be argued: If committing zina with a prostitute will be more effective, adopt that attitude (and commit the zina) with the intention for changing and reformation.
Change, reformation and hidaayat are possible only by following the Laws of Allah Ta’ala, not by acting in conflict as demanded by opinion and corrupt ‘hikmat’. Rasulullah’s mission was nothing other than Tabligh. There cannever be a greater Muballigh than Rasulullah (Sallallahu alayhi wasallam). Once Rasulullah (sallallahu alayhi wasallam) adopted a perfectly permissible method for Tabligh to bring the chiefs of the Quraish close to the Deen. The reasoning of our Nabi (Sallallahu alayhi wasallam) was that if the chiefs accept Islam, then all the tribes will follow suit and enter into Islam.

The chiefs being people of pride did not prefer people of low social rank to be with them in the same gathering. They had agreed to listen to the da’wat of Rasulullah (Sallallahu alayhi wasallam), and they attended the session. Whilst Rasulullah (Sallallahu alayhi wasallam) was engaging in Tabligh to the chiefs, an old, blind Sahaabi came to ask something. Rasulullah (Sallallahu alayhi wasallam) ignored him. Rasulullah (Sallallahu alayhi wasallam) was engaging with the chiefs and he did not want to miss this opportunity of gaining their allegiance for Islam. His only logical reason was to bring the chiefs close to Islam.

But Allah Ta’ala disapproved of this attitude and sternly reprimanded our Nabi (Sallallahu alayhi wasallam). The first 16 Aayaat of Surah Abasa record the reprimand of Allah Ta’ala. Now when our Nabi (Sallallahu alayhi wasallam) was so sternly reprimanded for a lawful attempt to bring important personalities close to the Deen with his Tabligh, what conclusion should we draw of the explicit haraam which the muftis are halaalizing for what they claim to be Tabligh? Haraam may not be adopted for Tabligh regardless of the perceived benefits, even if the person will be brought close to the Deen with the haraam, and even if the prostitute will accept Islam after the Muslim commits zina with her. It is absolutely satanic to argue that adoption of haraam is permissible for the purpose of Tabligh.

The fatwa of Mufti Ebrahim Desai is zig zag and designed to suffocate the Haqq. The person who asked the questions did not even do so in the context of Tabligh. He was asking in general. Thus the questioner asked:

“As fisq and fujoor is widespread, how should we uphold the Sunnah of Smiling in public?”

Although haraam may not be legalized for even Tabligh, the Mufti ministering to the evil designs of the elite wealthy class who are prominent and notorious for fisq and fujoor, issued his zig zag, corrupt fatwa which borders on kufr. Regardless of the widespread prevalence of fisq and fujoor, the ahkaam of the Deen may not be altered and abolished. Such tampering with the Shariah cannot be justified with the hallucination presented by the Mufti in his zig zag fatwa.

The Mufti has not presented a single Shar’i daleel to bolster his corrupt opinion. He has disgorged purely baseless personal opinion unsubstantiated by any Shar’i Nass. He is required to present a precedent from the Sunnah to justify his opinion. The end in view is not a valid daleel. If the end objective is to feed the poor and destitute, it does not justify gambling for this purpose.

We can say without fear of being contradicted by the Mufti that he will not say that for Tabligh purposes zina, wine and interest are permissible. Maybe in future some murtad mufti will halaalize even these major sins. But today, the Mufti will not issue a fatwa to halaalize zina, etc. for Tabligh purposes. The reason why these molvis are so brazen to halaalize the haraam act of honouring and respecting a faasiq is that the villainy of this sin has departed from their hearts. Their fraternization and socialization with the wealthy fussaaq and fujjaar have desensitized their Imaan, hence they have no inhibitions regarding the naked fisq and fujoor of the elite class. This desensitization has induced them to abandon Amr Bil Ma’roof Nahyi Anil Munkar. Thus they have opened the Doors for Allah’s Athaab.
