Molvi Irfan Nauyock of Mauritius issued a fatwa that there is no Eid Salaah during lockdown because there is no Izn Aam in private properties. Is his fatwa valid? Must we abandon Eid Salaat? On the basis of this fatwa, we are to abandon even Jumuah Salaat since Ithn Aam is also a condition for the validity of Jumuah Salaat.


The honourable Molvi Irfan did not apply his mind correctly hence his erroneous fatwa. Firstly, private property does not negate Izn Aam (general permission to the male Muslim public to attend). The condition of Izn Aam does not hinge on Waqf property. As long as musallis have free access to the venue during the Salaat time, the condition of Ithn Aam is satisfied.

The ‘fatwa’ of Molvi Nauyock is a jumble of confusion in which he sought to acquit himself like a mujtahid, hence he made a mess of the numerous narrations from the different Math-habs. He has no entitlement to resort to the variety of Hadith narrations on which the different Math-habs base their respective views. Furthermore, the vast majority of narrations does not even support the Izn Aam condition of the Hanafi Math-hab.

As a muqallid, he is required to remain within the confines of the Math-hab. Since he is a professed Hanafi muqallid, he had no right to indulge in a twaddle of excrescent citations which clearly displays cognitive dissonance.

According to the Hanafi Math-hab, even if the venue is not a Musjid, Eid and Jumuah Salaat will be valid with a minimum of four males (one to act as Imaam, and three Muqtadis). We fail to understand the ambiguity of ‘imaam’ in the current context of Muslim life. If by ‘imaam’, the Molvi means ‘Sultan’, then he dwells in confusion. The Ummah today has no political Imaam, i.e. Sultan/King/Ameerul Mu’mineen. Jumuah and Eid Salaat have been performed by the Ummah since time immemorial all over the world in places where there was no Sultan. Thus, introducing the ‘imaam/sultan’ factor is a flapdoodle indulgence, and so is the issue of ‘private property’. Eid and Jumuah Salaat are valid even in private property to which the Muslim male community is given access during the Salaat time.

It is extremely short-sighted, to say the least, to issue a fatwa for the abandonment of Jumuah and Eid Salaat solely on the basis of the rubbish lockdown satanism of the atheists. Assuming that Eid Salaat is not valid in private homes in terms of the Hanafi Math-hab (although it is valid), then too, the imperative demand will be to incorporate into our Math-hab the method and view of the other Math-habs in order to safeguard this significant, important and vital Act of Ibaadat. We shall opt for the fatwa of the other Math-habs in order to guard the Eid Salaat and to prevent Muslims from forgetting this important Practice of the Deen. It is not permissible to allow an Act of Ibaadat to become antique and discarded.

It is absolutely ludicrous to set aside the Haqq of the other Math-habs for compliance with the satanism of the atheists who have ordered the devilish lockdown. When there is scope in the Hanafi Math-hab for borrowing from the other Math-habs during occasions of dire need, then it will be imperative to do so, and not to abandon the Shar’i Hukm. However, as far as Eid and Jumuah Salaat are concerned during the satanic lockdown, there is no need for Hanafis to look askance to the other Math-habs in view of the fact that the condition of Izn Aaam is satisfied even in private homes.

Muslims themselves, by their wanton transgression and rebellion against Allah’s Shariah, have been the cause for the the defeats the Ummah suffered at the hands of the kuffaar, and for the ultimate loss of the entire glorious Empire established by Ameerul Mu’mineen Hadhrat Umar Ibn Khattaab (Radhiyallahu anhu).
Whatever sovereignty, respect and honour Muslims had were snatched away and the Ummah has laboured and trundled the trajectory of utter defeat and humiliation for centuries. The only spectacles of dignity and little independence left were our Musaajid and Darul Ulooms where we had enjoyed much freedom and the right to worship and teach the Qur’aan and Hadith as ordained by the Shariah.
However, in recent years, added to the cesspools of inequity, fisq, fujoor, bid’ah and kufr of the Muslim community among whom the worst culprits are the molvis and sheikhs, the Musaajid and Darul Ulooms have been pillaged, plundred and desanctified by Muslims themselves. The Musaajid became transformed into halls where najis tourists, men and women, were allowed to enter and pollute. Qawwaali, bid’ah jalsahs such as so-called ‘seerat’ jalsahs, women entering the Musaajid for Salaat, mass merrymaking I’tikaaf, fussaaq qaaris, allowing zindeeqs the Musjid platform, using the Musaajid as staging platforms for kuffaar sporting teams, introducing shayaateen en masse by means of the haraam spacing, etc., etc., are all acts which defiled the Musaajid.
In addition, one of the worst acts of pillage, is the non-attendance of 90% of the community for the daily Fardh Jamaat Salaat. Another villainous misdeed of the community is to allow absolute scoundrels to be the trustees and committees of the Musaajid. The Fajr and Isha attendance is the evidence for this percentage. These are the times when generally all persons are at home.
The villainy of Muslims have made the Musaajid ornate structures devoid of Deen. About our Musaajid of these times, Rasulullah (Sallallahu alayhi wasallam) said: “There shall soon dawn an era when nothing of Islam will remain but its name. Nothing of the Qur’aan will remain but its text. The Musaajid of the people will be ornate structures devoid of guidance. The worst of the people under the canopy of the sky will be their ulama. From them will emerge fitnah, and the fitnah will rebound on them.”
These Musaajid and the Darul Ulooms were the last remnants of our Islamic heritage. These were our little ‘empires’ where we held sway. But, Alas! Allah Azza Wa Jal has now snatched away from us these little dominions because we, with our own hands, have abused and defiled the sanctity of the Musaajid and transformed the Madaaris into mercenary and nafsaani institutions totally bereft of the Noor of Ilm. Imagine a Darul Uloom which is supposed to imbue in it the spirit and ethos of Ghaar-e-Hira, having a kuffaar sportsground.
These Musaajid, according to the Hadith, have invoked the La’nat of Allah on us, hence Allah Ta’ala has closed down the Musajid. Just imagine! You can go to the mall to acquire rubbish. But if on the way or next to the mall there is a Musjid, you are not allowed to enter and offer two raka’ts Tahyatul Musjid. This is a lamentable commentary on our own villainy.
The oppression of the government is in fact a mild form of Divine Chastisement. It is Allah Azza Wa Jal Who has empowered the government to evict us from our Musaajid. Rasulullah (Sallallahu alayhi wasallam) said: “If entire mankind unites to benefit you in any way whatsoever, they will be able to benefit you only to the degree prescribed by Allah, and if entire manking unites to harm you, they will be able to harm you only to the degree prescribed by Allah.”

If Muslims will continue with their drunken stupor of fisq, fujoor, bid’ah and kufr, the Greater Punishment (Al-Athaabul Akbar) mentioned in the Qur’aan will overtake us. Today we have lost the Musaajid and the Madaaris. Tomorrow it can be our homes. Allah forbid! Beware! Look at Burma, Palestine and Syria, and open your brains and heart for Muraaqabah.

“Beware of such a FITNAH (Punishment) which will not be restricted to only the transgressors among you.” (Qur’aan)
The Ulama and the Buzroogs will all be swept away in its onslaught. May Allah Ta’ala have mercy on us.

Question: In Natal someone by the name ‘Jazbhay’ is exhorting Muslims to come on to the streets to recite Takbeer on the day of Eid during the time when people are allowed to exercise in terms of the lockdown regulations. He invites women to also participate. Is this permissible?

Answer: How can Satanism be permissible? The chap is preaching Satanism under guise of Islam. It is haraam for women to emerge onto the streets. Such emergence and parading are the acts of prostitutes and lesbians. It is also not permissible for males to participate in this new-fangled bid’ah advised by a jaahil. The juhala and the munaafiqeen are in preponderance during this devil’s saga engulfing us.


Q. Should we perform Zuhr or Jumuah at home during the lockdown? Is a Musjid a requisite for the validity of Jumuah?

A. If you refer to our website you will find articles in which we have explained the issue of Jumuah during the devil’ lockdown. With four adult males, Jumuah may be performed at home. According to the Hanafi Math-hab, a Musjid is not a condition for the validity of Jumuah. It is a condition according to the Maaliki Math-hab.

Q. In Taraweeh the Imaam recites only Attahiyaat in Qa’dah. The Durood and Dua are totally omitted. Is this valid?

A. Even in Taraaweeh it is incumbent to recite Durood and Dua after Attahiyaat. It is a shaitaani inspiration to dispense with the Durood and Dua as is generally the case with those who rush with Taraaweeh. It is not permissible to discard the Durood and the Dua.

In a fatwa issued by Mufti Abdun Nabi Hamidi of whom we are not aware nor of the institution he represents, he has categorically stated that even in the present satanic scenario Eid Salaat at home will not be valid in terms of the Hanafi Math-hab. In this regard he states:

“The performance of Eid Salah at home cannot be validated as per Hanafi Mazhab as understood clearly from the above-mentioned quotation………Therefore, in the current lockdown situation, Eid Salah cannot be performed at home according to the Hanafi Fiqh.”

The invalidity is based on the incumbent condition of Ithnul Aam (general and open permission for all Muslims to attend) lacking if the Salaat is performed in a private home to which all Muslims have no access.

On this issue, we have advised that Eid Salaat may be performed at home, and that the following conditions should be observed:

(1) The minimum musallis present must be four adult males.

(2) The door should not be locked.

(3) Any Muslim who desires to join the Salaat may not be debarred.
In some measure this will fulfil the Ithnul Aam requisite. Due to the devilish state of affairs prevailing and the oppressive closure of the Musaajid by the oppressive government, and the numerous munaafiqeen prowling about to snitch to the police about Muslims performing Salaat in the Musaajid clandestinely, we are of the opinion that Eid Salaat on the basis of the aforementioned three conditions will be valid, Insha-Allah. This is our opinion. Allah Ta’ala knows best.

Jumuah Salaat had become Fardh only after the Hijrat from Makkah to Madinah. During the first phase of Nubuwwat in Makkah, due to fear for the Mushrik authorities, Rasulullah (Sallallahu alayhi wasallam) and the small band of Sahaabah performed Zuhr And Asr Salaat secretly in a house, hence the Qiraa’t was recited silently. We still observe this practice to commemorate that era of fear. There was no Jumuah in that initial phase in Makkah.

Jumuah and Eid Salaat are among the Shi-aar (salient/outstanding features) of Islam. These are Ibaadat activities to be publicized and advertised. Thus, performing Jumuah and Eid Salaat at home does divest these Salaats from their salient characteristic.

Therefore, despite our opinion, we do not take issue with the Mufti Sahib who holds the opinion of invalidity. This is such a difference on which we are not dogmatic.

We have dogmatically propagated that Jumuah is not valid in any prison. We trust that this Mufti has the same fatwa of invalidity for Jumuah in prison.

Since according to the Shaafi’ Math-hab Eid Salaat is valid even at home, the rigidity of the Hanafi prohibition due to the current shaitaaniyat is somewhat diluted, hence we are of the opinion that Eid Salaat at home in the present circumstances will be valid. If it was not for the current Satanism, it would not be permissible at all for Hanafis to depart from the Fatwa of their Math-hab.

Q: What are the laws pertaining to Takbeer-e-Tashreeq?


A: The relevant masaail pertaining to Takbeer-e-Tashreeq are as follows:


1. Q: What is the position of Takbeer-e-Tashreeq in Deen?

A: Takbeer-e-Tashreeq is waajib in Deen.


2. Q: When should the Takbeer-e-Tashreeq be recited?

A: It should be recited after every fardh Salaah, whether the Salaah was performed individually or in congregation.


3. Q: How many times should it be recited after every fardh Salaah?

A: It should “only” be recited once.


4. Q: On whom is Takbeer-e-Tashreeq waajib?

A: It is waajib on both baaligh men and women. However, men should recite it audibly and women should recite it softly.


5. Q: If one forgets to recite it after Salaah, then what should be done?

A: If the person remembers whilst seated on the musalla and has not yet spoken to anyone, then he should recite the Takbeer-e-Tashreeq. However, if he has spoken or engaged in any worldly activity, then the Takbeer-e-Tashreeq will fall off.


6. Q: If one intentionally leaves out reciting the Takbeer-e-Tashreeq, will he be sinful?

A: He will be sinful on account of omitting a waajib of Deen.


7. Q: For how many Salaah will the Takbeer-e-Tashreeq be recited?

A: The Takbeer-e-Tashreeq will be recited for twenty three Salaah commencing from the Fajr of the ninth of Zul Hijjah and terminating on the Asr of the thirteenth of Zul Hijjah.


8. Q: In the case where one is making qadha for missed Salaah during the days of Tashreeq, should he recite the Takbeer-e-Tashreeq after the qadha Salaah?

A: The Takbeer-e-Tashreeq will only be recited after those qadha Salaah which were missed during the days of Tashreeq of the same year.


9. Q: Should the Takbeer-e-Tashreeq be recited after the Eid Salaah?

A: It should be recited after the Eid Salaah.

Eid for Muslims is not as Christmas day for Christians who make merry and indulge in sin on their supposedly holy day. While the kuffaar celebrate their holy days with parties and merrymaking, Muslims are required to spend the Days of Eid with obedience and Ibaadat. However, most Muslims are equating the Day of Eid to the occasions of kuffaar merrymaking days.
Sin is inseparable from the style of merrymaking practised by Muslims nowadays on Eid occasions. It comes in the Hadith that sinning on the Day of Eid is like sinning on the Day of Qiyaamah.
The nights of Eid are like Lailatul Qadr. An atmosphere of holiness should pervade the homes on the Days of Eid. On the contrary, Eid Days are ruined with the fitnah of parties and haraam merrymaking. In many places, congregation of relatives and friends mar the holiness of Eid.
Purdah/Hijaab is scandalously violated by the throng of men and women all dressed and adorned for maximum attraction of the opposite sex. Shaitaan deceives them with the stupid argument of ‘family ties’. On this pretext ghair mahaareem congregate at a house where it is impossible to observe the degree of purdah ordered by the Shariah.
Furthermore, gathering for “eid” parties has no basis in Islam. It is an evil bid’ah custom which the juhaala have made incumbent. If a family member does not participate in the fitnah, he/she is accused of breaking family ties. This is the inspiration of shaitaan.
On the Day of Eid, people should remain at home with their family (wife and children). It is not an occasion for visiting others to party and make merry. Refusing to join the merrymaking crowd is not “breaking of family ties”.
Allah Ta’ala says in the Qur’aan Majeed:
“The life of this world is but play and amusement while the Abode of the Aakhirat is best for those who have fear for Allah Ta’ala.”
